Ceist:

322 Mr. Byrne asked the Minister for the Environment if he will amend the Air Pollution Act, 1987 as recommended by the environmental sub-committee of Dublin Corporation, namely (1) to amend section 41 to provide for the holding of a public inquiry where objections are received, except where the grounds of objection have already been decided by him and (2) to amend section 45 of the Act to extend the grants scheme to those areas which are the subject of a special control order by the City Council, with a view to expediting the rate of conversion; and if he will make a statement on the matter.

Under the Government's environmental action programme which was announced on 26 January, a prohibition on the marketing, sale and distribution of bituminous coal in the built-up area of Dublin will come into effect from 1 October 1990. In view of this, no further special control area orders will be confirmed, apart from the Special Control Area (Ballyfermot Area D) Order, 1989. Accordingly, the question of amending the Air Pollution Act, 1987, as recommended, does not arise at this time.
