Written Answers. - Dublin Court Case Delay.

Ceist:

201 Mr. Bell asked the Minister for Justice the reason for the unreasonable delay in finalising the case of a person (details supplied) in Dublin 12; if his attention has been drawn to the fact that this case was withdrawn by the Director of Public Prosecutions, if he is aware that it was indicated that this case would be re-entered; his views on whether this is fair and satisfactory way to conduct the business of law and most unjust to the man concerned and his family; and if he will make a statement on the matter.

The position is that the institution or non-institution of criminal proceedings is a matter for the Garda authorities acting, where necessary, on the advice of or in consultation with the Director of Public Prosecutions and I have no function in the matter.

As the Director of Public Prosecutions is independent in the exercise of his functions, it would not be appropriate for me to commenbt on any decision made by him.
