Written Answers. - Release of Guilty/Insane Persons.

113 Mr. Rabbitte asked the Minister for Justice if the examination of the decision of the High Court that decisions on the release of persons found guilty but insane were an executive rather than judicial function, which he informed Dáil Éireann in reply to Parliamentary Question No. 218 of 20 February 1990 was in progress in his Department, has yet been concluded; if not, if any deadline has been set for its conclusion; the form which the examination is taking; if it is intended to publish the results; and if he will make a statement on the matter.

Examination of this matter cannot be concluded until the outcome of an appeal which has been taken to the Supreme Court against the judgment of the High Court is known. It is an internal departmental examination of the type which routinely takes place when an issue of this nature arises and there is no question of a formal report or publication of results.
