Written Answers. - Bank Cash Dispensing Machines.

Ceist:

123 Mr. Gregory asked the Minister for Industry and Commerce if he will investigate the present position regarding the various banks which have cash dispensing machines adjacent to public footpaths without street trading licences; if he will take appropriate action; and if he will make a statement on the matter.

The Street Trading Act, 1926, in so far as it applied to casual trading, was repealed by the Casual Trading Act, 1980, which provides for the control and regulation of casual trading and connected matters. The Act defines "casual trading" as selling goods by retail at a place, including a public road, to which the public have access as of right or at any other place that is a casual trading area. The use by banks of cash dispensing machines would not in my opinion be covered by this definition and, accordingly, would not need to be licensed under the Act. I do not consider it necessary that the Act be amended to provide for this.
