Written Answers. - Social Welfare Benefits.

Tony Gregory

Ceist:

125 Mr. Gregory asked the Minister for Social Welfare the reason persons (details supplied) in Dublin 7 who live with their parents, both of whom are in receipt of the old age pension, were refused unemployment assistance; if he will review the position; and if he will make a statement on the matter.

The persons concerned, two brothers, are not in receipt of unemployment assistance as the means assessed against each of them exceed the maximum weekly rate of unemployment assistance payable in each case. The means in each case are derived from the benefit of the value of board and lodgings in their parents' home.

One of the persons concerned has ceased to sign the unemployed register. The other has applied for a review of his means and his case has been referred to the social welfare officer for further investigation. On completion of the social welfare officer's report, his entitlement to unemployment assistance will be reviewed.

Liam Fitzgerald

Ceist:

126 Mr. L. Fitzgerald asked the Minister for Social Welfare the reason a person (details supplied) in Dublin 17 has been refused unemployment assistance on an appeal basis since the person was prepared at all times to disclose details of his wife's income; if at any time since 28 September 1989 certified evidence of means was sought; if so, when; if he will further review this case; and if he will make a statement on the matter.

Following investigation, the unemployment assistance claim of the person concerned was disallowed by a deciding officer from 28 September 1989 on the grounds that he had failed to show that his means did not exceed the statutory limit for receipt of a qualification certificate. In particular he failed to satisfy the deciding officer that a van, registered in his name, is being used for private and social purposes only. He appealed against the disallowance and his case was considered by the social welfare appeals office. An appeals officer decided that he failed to show that his means did not exceed the statutory limit.

During the course of the investigation, the person concerned admitted to the social welfare officer that his wife had been insurably employed for a number of years and that he had deliberately failed to disclose this information to the Department. His entitlement to a qualification certificate and to unemployment assistance during the years his wife was employed will now be reviewed by a deciding officer.

Liam Aylward

Ceist:

127 Mr. Aylward asked the Minister for Social Welfare the reason unemployment assistance or unemployment benefit is not being paid to a person (details supplied) in County Kilkenny.

Following investigation, the unemployment assistance claim of the person concerned was disallowed from 31 October 1990 on the grounds that his means exceeded the statutory limit for receipt of a qualification certificate.

He appealed against the decision and further investigations are being made in connection with his appeal before it is submitted to the social welfare appeals office.

He will be informed of the outcome as soon as a decision is given.

Gay Mitchell

Ceist:

128 Mr. G. Mitchell asked the Minister for Social Welfare if arrears of disability benefit will be paid to a person (details supplied) in Dublin 12 who was erroneously cut off from disability benefit; and if benefit at the full rate will now be paid.

Arrears of disability benefit are not payable in respect of the person concerned.

The person concerned, who is in receipt of deserted wife's benefit was also in receipt of unemployment benefit and disability benefit from August 1990 to 21 November 1990 when benefit was discontinued. She was examined by a medical referee who expressed the opinion that she was capable of work. She has since applied for unemployment benefit and is being paid by her local office.
