Written Answers. - Detention Pending Extradition Recommendation.

Ceist:

86 Proinsias De Rossa asked the Minister for Justice in relation to the Council of Europe Recommendation No. R (86) 13 of 16 September, 1986, that time spent in custody pending extradition should be deducted from the sentence in the same manner as time spent in custody pending trial if he will outline the response which has been made by his Department to the recommendation; and whether it is intended to incorporate it into law.

Council of Europe Recommendation No. R (86) 13 relates to the practical application of the European Convention on Extradition, to which Ireland is a party, in respect of detention pending extradition. In the period since the recommendation was adopted, no case involving this country, to which the recommendation would have applied, has arisen under the convention.

With regard to the issue of amending the law, I could not undertake to indicate by way of reply to parliamentary questions what legislative proposals I might have in any particular area. In accordance with normal practice, any legislative proposals I may have will be announced in the ordinary way when they have been considered and approved by Government.
