Ceist:

262 Mr. Garland asked the Minister for the Environment whether the Bundoran UDC Waterworld Project has been the subject of the planning process; if not, the reason; his views on whether such developments should be subjected to the normal planning process in view of the substantial change such developments render to the coastline; whether it is his intention to consider any change in the planning legislation; and if he will make a statement on the matter.

Development by a planning authority within its functional area is exempted development by virtue of section 4 (1) (d) of the Local Government (Planning and Development) Act, 1963. Under section 39 of the 1963 Act, a planning authority may not effect any development which contravenes materially its development plan.

Certain development projects by local authorities come within the scope of the European Communities (Environmental Impact Assessment) Regulations, 1989 and are, therefore, subject to EIA procedures.

I have no proposals at present to amend the law in relation to these matters.
