Written Answers. - Social Welfare Benefits.

Tony Gregory

Ceist:

194 Mr. Gregory asked the Minister for Social Welfare the reason a person (details supplied) in Dublin 7 was refused unemployment assistance/unemployment benefit when he lost his job through no fault of his own; if he will review this person's entitlement; and if he will make a statement on the matter.

The person concerned ceased work on 8 February and claimed unemployment benefit. His claim was disallowed by a deciding officer for six weeks on the grounds that he had lost his employment through his own misconduct. The six weeks disallowance period will have expired by 25 March 1991 and it will be open to the person concerned to renew his claim as from that date.

On 7 March he appealed against the six week disallowance to the social welfare appeals office. He will be notified of the outcome of the appeals officer's decision as soon as it is available.

Michael Moynihan

Ceist:

195 Mr. Moynihan asked the Minister for Social Welfare if he will investigate the delay on the part of his Department in giving a decision on the application of a person (details supplied) in County Kerry for occupational injuries benefit.

The person concerned was paid disability benefit from 11 April 1990 to 18 June 1990. He also received pay-related benefit. He claimed injury benefit on 13 August 1990 in respect of an accident at work on 6 April 1990.

On investigation, his employers denied that the reported accident had happened. The claim was referred to the social welfare officer for investigation and on receipt of his report, the claim was allowed. Injury benefit was awarded from 7 April 1990 to 18 June 1990 — the period in respect of which he had received disability benefit — and from 13 August 1990 to 4 October 1990, the end of the 26 week injury benefit period from the date of accident. He was also awarded pay-related benefit.
The delay in deciding the injury benefit claim arose because the claimant did not indicate that his first claim, in April 1990, was for injury benefit. Arrears due for the period 13 August 1990 to 4 October 1990 issued on 8 March 1991. The amount paid was adjusted to recover an overpayment of benefit which occurred in 1985. Arrears due for the period 7 April 1990 to 18 June 1990 issued on 11 March 1991.
He is currently in receipt of disability benefit and pay-related benefit. It is open to the claimant to claim disablement benefit if, as a result of the accident, he has suffered any loss of physical or mental faculty. A claim form has been issued to him.

Liam Fitzgerald

Ceist:

196 Mr. L. Fitzgerald asked the Minister for Social Welfare when full benefit will be paid to a person (details supplied) in County Wexford.

The person concerned is currently in receipt of old age contributory pension at the maximum personal rate of £61.50 a week. The person concerned may also be entitled to a living alone allowance and fuel allowance now. Application forms for these allowances have been issued to him.

His wife, who died on 6 December 1990, was in receipt of an old age noncontributory pension. This pension is paid in advance each week. Accordingly, it was not possible to award the Christmas bonus in her case; the bonus was payable from 7 December 1990.
