Ceist:

223 Mr. Quinn asked the Minister for Health whether in respect of the completion of the Internal Market by 1992, he will outline in respect of his Department (1) which directives are his responsibility, (2) the directives which have now been passed, (3) the draft directives which remain outstanding and (4) when these outstanding draft directives will be passed; and if he will make a statement on the matter.

The information requested by the Deputy in relation to EC Directives which come under my area of responsibility is set out in the following tabular statement:

1. (A)Directives Adopted by the Council
(i)Relating to Foodstuffs:
85/585 of 20 December 1985 concerning preservatives for use in foodstuffs.
85/591 of 20 December 1985 on methods of sampling and analysis of foodstuffs.
86/102 of 24 March 1986 relating to emulsifiers, stabilisers, thickeners and gelling agents for use in foodstuffs.
88/344 of 13 June 1988 on the use of extract solvents used in the production of foodstuffs.
88/388 of 20 June 1988 relating to flavourings for use in foodstuffs.
89/107 of 21 December 1988 concerning additives for use in foodstuffs.
89/397 of 14 June 1989 on the official control of foodstuffs.
89/398 of 3 May 1989 on foodstuffs intended for particular nutritional uses.
90/496 of 6 October 1990 on nutrition labelling of foodstuffs.
(ii)Relating to Medicinal Products:
87/19 of 22 December 1986 relating to analytical, pharmo-toxicological and clinical standards and protocols in respect of the testing of proprietary medicinal products.
87/20 of 22 December 1986 relating to analytical pharmo-toxicological and clinical standards and protocols in respect of the testing of veterinary medicinal products.
87/21 of 22 December 1986 relating to proprietary medicinal products.
87/22 of 22 December 1986 relating to high technology medicinal products.
88/667 of 22 December 1986 relating to cosmetic products.
89/341 of 3 May 1989 amending previous directives on proprietary medicinal products.
89/342 of 3 May 1989 laying down additional provisions for immunological medicinal products consisting of vaccines, toxins or serums and allergens.
89/343 of 3 May 1989 laying down additional provisions for radio-pharmaceuticals.
89/381 of 14 June 1989 relating to proprietary medicinal products and laying down special provisions in relation to medicinal products derived from human blood and human plasma.

(iii)Relating to Other Matters:
89/105 of 21 December 1988 relating to the transparency measures regulating the pricing of medicinal products and their inclusion in the scope of national health insurance systems.
89/594/EEC
(i) mutual recognition of diplomas, certificates and other evidence of formal qualifications as doctor, nurse responsible for general care, dental practitioner, and midwife;
(ii) concerning the co-ordination of provisions laid down by law, regulation or administration action, relating to the activities of doctors and midwives.
89/595/EEC specifies a minimum duration of basic training and clinical training for general nursing. This directive applies only to those students who commence training after 13 October, 1991.
(B)Directives Adopted by the Commission
Relating to Foodstuffs:
91/71 of 16 January 1991, completing Council Directive 88/388 on flavourings for use in foodstuffs.
90/612 of 26 October 1990, relating to emulsifiers, stabilisers, thickeners and gelling agents for use in foodstuffs.
2. (A)Proposals for Directives Under Consideration by the Council
(i)Relating to Foodstuffs:
COM(88)654 concerning foods and food ingredients treated with ionizing radiation.
Ireland supports the basic principles of the proposal.
COM(90)381 concerning sweetners for use in foodstuffs.
Currently under consideration at Council working party level. Adoption by the Council should take place before the end of the year.
(ii)Relating to Medicinal Products:
COM(89)607 concerning the wholesale distribution of medicinal products for human use.
COM(89)607 concerning the legal status for the supply of medicinal products for human use.
COM(89)607 concerning the labelling of medicinal products for human use and on package labels.
COM(90)283 concerning amendment of Directives 65/65/EEC, 75/318/EEC and 75/319/EEC on the approximation of provisions laid down by law, regulation or administrative action relating to medicinal products.
COM(90)283 concerning amendment of directives amending Directives 81/851/EEC and 81/852/EEC on the approximation of the laws of member states relating to veterinary medicinal products.
COM(90)283 concerning the repeal of Directive 87/22/EEC on the approximation of national measures relating to the placing on the market of high technology medicinal products particularly those derived from biotechnology.
COM(90)283 concerning the laying down of Community procedures for the authorisation and supervision of medicinal products for human and veterinary use and establishing a European Agency for the Evaluation of Medicinal Products.
Ireland supports the basic principles of the above proposals.
COM(90)488 relating to cosmetic products.
The proposal was published in February 1991 and is under consideration at present.
(iii)Relating to Other Matters:
COM(87)557 concerning the mutual recognition of qualifications in medicine, nursing, dentistry, veterinary medicine and midwifery. These proposals were recently agreed by the Council.
Draft proposal for a Council Directive as regards specialist nursing, particularly psychiatric and paediatric care.
Draft issued from Brussels 13 December 1990 — at present under scrutiny — not possible at this stage to say when directive will be passed.
(B)Proposals for Commission Directives under Consideration
(i)Relating to Foodstuffs:
3712-90-EN-Rev4 — concerning infant formulae and follow on formulae.
Adoption by the Commission should take place within the coming months.
