101 Mr. Barry asked the Minister for the Marine if his Department and the State agencies under his control have prepared a safety statement as required under the Safety, Health and Welfare at Work Act, 1989.

In relation to my own Department, draft safety statements have been prepared and are being finalised at present for a number of areas including the Department at Leeson Lane; the Fisheries Research Centre at Abbotstown and Dún Laoghaire Harbour. Draft safety statements for other areas where Roinn na Mara operate, including my Department's fishery harbour centres, are well advanced.

As regards the State agencies under my control the position is as follows: The 25 scheduled harbour authorities under the aegis of my Department are solely responsible for the preparation of safety statements under the terms of the Safety, Health and Welfare at Work Act, 1989.

However, due to the importance of this Act, my Department have written to each authority (on two occasions this year) to inform them of their responsibilities under the Act and request that they report on their progress in this matter.
Eight of the harbour authorities do not have any employees and therefore are not subject to the terms of the Act. The other authorities are at obvious stages in the preparation of their safety statements. It is hoped that the statements in question will be finalised shortly.
The Central and Regional Fisheries Board have advised my Department that they have proposed and adopted a safety statement.
Bord Iascaigh Mhara are in the process of preparing a safety statement and I am assured that it will be finalised by the end of the year.
Arramara Teoranta have prepared a safety statement and indeed have had a safety statement in place for 12 months.
Foyle Fisheries Commission are actively pursuing the completion of a safety statement. As a cross-Border body, the Commission are also required to comply with Northern Ireland legislation. The commission would hope to be in a position to adopt a safety statement as soon as agreement is reached with all concerned.
