Ceist:

34 Mr. Kenny asked the Minister for the Environment whether any precedent exists for him to overrule a ban in a county development plan on a particular activity; and if he will outline the Government's position in cases where any such ban is contrary to stated Government policy; and if he will make a statement on the matter.

The power under section 22 (3) of the Local Government (Planning and Development) Act, 1963 to require a planning authority to vary their development plan has never been used. The question of whether it would be appropriate to invoke the power in any case would fall to be determined in the light of the particular circumstances pertaining in that case.
