Ceist:

154 Mr. Garland asked the Minister for Agriculture and Food if he will list the number of EC Directives applicable to his Department which are not yet in force in Irish law; and the reason for the delay in the case of each Directive.

Details of the EC Directives for which my Department is responsible and are not in force in Irish law are set out in the following tabular statement. As the Deputy will understand, the drafting and preparation of the necessary legislation is a complex and time consuming operation which requires a high degree of consultation between my Department, the Office of the Parliamentary Draftsman and the Office of the Attorney General. There is a total of 43 Directives not yet implemented. Some are at the finalisation stage and I expect that 7 of these will be published in Iris Oifigiúil within the next few weeks.

As regards the remaining 36, it would involve an excessive expenditure of time to describe for each the various difficulties encountered in providing for implementation. I can say however that 10 of these instruments have already been drafted in full in my Department and are currently under examination by the legal offices of the Government or are being revised by my Department following such examination, or are in the process of parliamentary drafting. In the case of the remainder, detailed preparatory work is being carried out by my Department and every effort is being made to expedite this process.

If the Deputy wishes to put down a more specific question or questions about any particular Directive or Directives in which he is interested I would be happy to give him more detailed information.

I can assure the Deputy that no effort will be spared by my Department to ensure the earliest possible implementation of the outstanding Directives.

Ceist:

155 Mr. Garland asked the Minister for Social Welfare if he will list the number of EC Directives applicable to his Department which are not yet in force in Irish law; and the reason for the delay in the case of each Directive.

The only EC Directive applicable to my Department which is not yet in force is Directive 86/613/EC which concerns access to social insurance coverage for spouses of self-employed workers.

This question is currently being looked at by the Pension Board in the context of its report on a new pensions system. Possible legislation in this area will be considered in the light of that report.
