Written Answers. - EC Directives.

Ceist:

117 Mr. Garland asked the Minister for Energy if he will list the number of EC Directives applicable to his Department which are not yet in force in Irish law, and the reason for the delay in the case of each Directive.

In my reply to a previous Dáil Question on 18 February, 1992 I specified certain Directives which I do not intend to transpose into Irish Law in view of new draft Directive proposals which are likely to be adopted in the near future. This is still the position.

Particulars of other EC Directives falling within my area of responsibility which require statutory measures to be taken are as follows:

Implementation Date

1. 90/377/EEC:

Council Directive of 29 June, 1990 concerning a Community procedure to improve the transparency of gas and electricity prices charged to industrial end-users.

1 July, 1991

2. 89/618 Euratom:

Council Directive of 27 November, 1989, on informing the general public about health protection measures to be applied and steps to be taken in the event of a radiological emergency.

26 November, 1991

3. 90/641/Euratom:

Council Directive of 4 December 1990 on the operational protection of outside workers exposed to the risk of ionizing radiation during their activities in controlled areas.

31 December, 1993.

4. 92/3/Euratom:

Council Directive of 3 February 1992 on the supervision and control of shipments of radioactive waste between Member States and into and out of the Community.

The Energy Council on 21 May, 1992 adopted a Directive on efficiency requirements for new hot-water boilers fired with liquid or gaseous fuels.

1 January, 1993

The position in regard to implementation is as follows:
Item 1: The requirements of the Directive are being complied with. Both BGE and ESB are supplying the necessary information and statistics relating to gas and electricity prices by way of administrative arrangements. Statutory provision, giving legal effect to the arrangements is being incorporated in legislation being prepared by my Department and expected to be enacted this year.
Item 2: It was originally considered that the measures in relation to radiological emergency planning already in place in Ireland fulfilled our obligation to comply with this Directive. However, following consultation with the EC Commission, we have agreed to provide a statutory measure by way of a Regulation under the Radiological Protection Act 1991 before 31 December, 1992.
Items 3, 4, 5: Statutory measures will be taken as required and within the time-scale laid down in the Directives.

Ceist:

118 Mr. Garland asked the Minister for the Marine if he will list the number of EC Directives applicable to his Department which are not yet in force in Irish law; and the reason for the delay in the case of each Directive.

There is no delay in the implementation of EC Directives applicable to my Department: (a) "Council Directive concerning the animal health conditions governing the placing on the market of aquaculture animals and products"; (b) "Council Directive concerning the health conditions governing the production and placing on the market of fish and fishery products"; (c) "Council Directive concerning the health conditions governing the production and placing on the market of live bivalve molluscs."

As the implementation date for each of these Directives is 1 January, 1993 the question of delay does not arise.
