Ceist:

127 Mr. Haughey asked the Minister for Justice the persons who can officially obtain a Garda criminal record of any person; and, in particular, if an employer, in association with his insurance company, can obtain such information in respect of a potential employee.

It is not the practice to disclose information held by the Garda Síochána on a person's criminal convictions to an employer or other third party except in certain limited and exceptional circumstances. The decision as to whether or not to disclose information in any individual case would not be influenced by the involvement of an insurance company in the request for information.

Under the Data Protection Act, 1988 an individual may be supplied with a copy of information relating to himself or herself, including information on criminal convictions, which constitutes personal data held by the Garda Síochána.
