82 Mr. Durkan asked the Minister for Social Welfare the way in which a medical referee found a person (details supplied) in County Kildare to have disablement, as a result of occupational injury, at 30 per cent when her condition is considerably worse since she first claimed which is verifiable by her own doctor; and if he will make a statement on the matter.

The person concerned is in receipt of disablement benefit under the occupational injuries scheme since 3 December 1985. She is also in receipt of invalidity pension at the rate of £85.80 a week.

Her disablement benefit which was at the rate appropriate to an assessment of 40 per cent was payable up to 27 May 1993. The outcome of the examination which was carried out by a medical referee on 30 April 1993 has now been reviewed by the medical adviser. In view of the circumstances, it has been decided that the level of assessment which applied up to 27 May 1993 should continue to stand pending further review. Payment of disablement benefit at the weekly rate of £31.40 is accordingly being restored from 28 May 1993.

If she is not satisfied with the decision it is open to her to appeal against it by writing to the independent Social Welfare Appeals Office, D'Olier House, Dublin 2, indicating the ground on which she bases her case and enclosing any medical evidence in support of the appeal.
