Written Answers. - Harbour Works Contracts.

54 Mr. Killeen asked the Minister for the Marine if his Department has placed any contracts with non-Irish companies for harbour works since 1980; and if a select list was in operation for any of these contracts.

Prior to 1 January 1989 the Department of the Marine, which was established in 1987, did not itself undertake harbour works. These were carried out, on behalf of the Department, by the Office of Public Works. Since 1989, the Department of the Marine has carried out harbour works directly either by contract or by direct labour.

Where contracts are involved, the Department operates a competitive tendering system and awards contracts to the lowest suitable tenderer or most economically advantageous tender for any particular project. Companies from all EC member states are eligible to tender for Department of the Marine projects. This is in line with EC Public Procurement Directives, in particular the "Works Directive — 89/440/EEC".
Such contracts have been awarded to non-Irish companies on two occasions. Both contracts were awarded after open tendering procedures. In all other instances Irish companies were awarded contracts.
In regard to the operation of select lists, I can confirm that an open tendering procedure has always been implemented for harbour works contracts. It is not the policy of the Department to use negotiated or restricted procedures for harbour works unless such procedures can be shown to be in the interests of best value for State investment.
