Ceist:

119 Mr. G. Mitchell asked the Minister for Enterprise and Employment if an award made to a person (details supplied) in Dublin 12, will be fully paid under the terms of the Minimum Notice and Terms of Employment Acts, 1973-1991; and if he will make a statement on the matter.

The Employment Appeals Tribunal made an award of compensation to the employee concerned under the Minimum Notice and Terms of Employment Acts, 1973 to 1991. The employer has failed to comply with the determination of the tribunal and the employee's solicitor referred the matter to my Department on 9 August 1993.

Under the provisions of the Minimum Notice and Terms of Employment Acts, the Minister for Enterprise and Employment may institute proceedings against a defaulting employer for recovery of the sum awarded. Accordingly, papers in the case have been submitted to my legal advisers for consideration as to the institution of proceedings against the employer. At this stage, I am unable to say what the outcome of the legal advice will be. The employee will be kept informed of developments in the case as they arise.
