73 Mr. Callely asked the Minister for Health if he has satisfied himself that our mental health legislation complies with EU directives; and if he will make a statement on the matter. [7126/95]

Limerick East): It is my understanding that EU directives do not extend to mental health legislation of member states. I am, however, committed to the early introduction of new mental health legislation to provide a modern framework within which the relatively small number of people with mental disorder who refuse or who are incapable of seeking treatment or protection in their own interest or in the interests of others can be cared for and treated. As a prelude to the introduction of new legislation I will in the near future be publishing a White Paper on mental health legislation outlining the Government's intentions with regard to the content of new legislation in this field. The White Paper will contain details of proposals to meet this country's international commitments principally the European Convention for the Protection of Human Rights and Fundamental Freedom.
