Vol. 455 No. 2

Written Answers. - Worker Protection Legislation.

Tom Kitt

Ceist:

161 Mr. T. Kitt asked the Minister for Enterprise and Employment when he will introduce legislation on protection for part-time workers which would clarify the central issues in the Dunnes Stores dispute. [12058/95]

Since the introduction of the Worker Protection (Regular Part-Time Employees) Act, 1991, regular part-time employees have enjoyed equivalent protection to that applying to full-time employees under worker protection legislation. The 1991 Act extended the protection of the following legislation to regular part-time employees; Holidays (Employees) Act, 1973; Redundancy Payments Acts, 1967 to 1990; Minimum Notice and Terms of Employment Acts, 1973 and 1984; Worker Participation (State Enterprises) Acts, 1977 and 1988; Unfair Dismissals Act, 1977; Maternity Protection of Employees Act, 1981 and Protection of Employees (Employers' Insolvency) Acts, 1984 and 1990.

Regular part-time employees also enjoy the protection of the Maternity Protection Act, 1991, Adoptive Leave Act, 1995 and the Terms of Employment (Information) Act, 1994.

Because of the serious situation that has developed in regard to the Dunnes Stores dispute, the Labour Court has intervened in accordance with the terms of section 26 (5) of the Industrial Relations Act. Invitations have been issued to both parties to attend the court today to assist the court in its investigation. I understand that Dunnes Stores is making a submission to the Labour Court. I hope that this initiative by the court will lead to an early resolution of the dispute.
