Ceist:

78 Mr. Dempsey asked the Minister for the Environment if he will publish his correspondence with Commissioner Wulf-Mathies and between his Department and the EU Commission regarding Mutton Island, Galway. [6620/96]

Liam Aylward

Ceist:

80 Mr. Aylward asked the Minister for the Environment if the Government intends to contest pending legal action over Mutton Island, Galway on the grounds of EU wildlife legislation. [6623/96]

I propose to take Questions Nos. 18, 53, 78 and 80 together.

I am arranging to make copies of the relevant correspondence, some of which has already been in wide circulation, available in the Oireachtas Library.

No legal proceedings in this matter have been initiated by the European Commission which has the sole competence under the Treaty for taking action of this kind nor have I had any indication that such proceedings are intended.

I have no reason at present to anticipate that legal proceedings will delay the provision of the much needed secondary waste water treatment facilities for Galway City.

What does the Minister mean by "relevant correspondence"?

All correspondence relevant to this case that pertains to the provision of secondary treatment in Galway. It will be available in the Library from this evening.

Will all the letters that passed between the Minister and the Commissioner and between the Department and the Commission be placed in the Library? I thank the Minister if that is so.

That is my intention and it includes the convoluted procedures from the Commission stamped in French, "Not for Publication".
