Ceist:

101 Mr. N. Ahern asked the Minister for Justice whether details of a person's prison record is covered by the Data Protection Act; if so, the exemptions, if any, that exist; and if it is in order for members of the Garda/security forces to reveal such details to employers in respect of their employees. [8899/96]

In accordance with the provisions of the Data Protection Act, 1988, an individual may, subject to the restrictions set out in section 5 of the Act, be supplied with information relating to his/her prison record which constitutes personal data held on computer by my Department. It is not the practice to disclose information on a person's prison record to an employer or other third party.

In relation to the Garda Síochána, I might add that it is not the practice to disclose information held by the Garda Síochána on a person's criminal convictions to an employer or other third party except in certain limited and exceptional circumstances.
