Ceist:

237 Mr. O'Donoghue asked the Minister for Justice whether there is an obligation on the Garda Commissioner to advise her of the transfer of a garda on the grounds of negligence in the course of his duties; and, if not, whether it is customary for the Garda Commissioner to so inform her of such a transfer. [11777/96]

The Police Forces Amalgamation Act, 1925, provides that the general direction and control of the Garda Síochána is vested in the Commissioner. The allocation and transfer of gardaí within the provisions of that Act is entirely a matter for the Garda Commissioner. Consequently, there is no obligation on the Commissioner nor is it customary for him to advise the Minister of such decisions.

238 Mr. O'Donoghue asked the Minister for Justice when her attention was first drawn to the transfer to other duties of the garda who received or handled the original warrant in the Anthony Duncan extradition case. [11779/96]

I refer the Deputy to the statement I made on this matter in the Dáil on 23 May and to the answers to the questions which followed that statement, when I said that my attention was first drawn to this matter on 22 May.
