Vol. 469 No. 5

Written Answers. - Enforcement of Court Orders.

Patrick D. Harte

Ceist:

192 Mr. Harte asked the Minister for Justice whether she will introduce legislation to make illegal action of the kind displayed by the acting Sheriff in executing the Order of the Supreme Court at An Grianán farm, Burt, County Donegal, on 12 August 1996. [16182/96]

The law in relation to the execution of court orders is contained in the Enforcement of Court Orders Acts, 1926 to 1940.

I am satisfied that this legislation provides sheriffs with the necessary powers, rights and authorities, subject to the appropriate duties and obligations, for the enforcement of court orders and I have no proposals at present to amend the law as suggested by the Deputy.

I would also refer the Deputy to my reply to a Parliamentary Question No. 479 on this matter from Deputy Michael P. Kitt on 25 September 1996.
