192 Mr. E. Ryan asked the Minister for Arts, Culture and the Gaeltacht if he intends to agree compensation with landowners before their land is designated under EU Directive 79/409EEC, the Birds Directive. [21669/96]

The making of Regulations under the European Communities Act, 1972, to transpose Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora (Habitats Directive) into Irish law is in the final stage of preparation. The regulations, when made, will give the same protection to special protection areas designated under Council Directive 79/409/EEC on the conservation of wild birds (Birds Directive) as to special areas of conservation to be designated under the Habitats Directive. The regulations will set out the requirements for protection of these sites and the question of compensation, if any, will be viewed in the light of these requirements.
