118 Mr. Barry asked the Minister for the Environment whether the reference to aircraft in the Local Government (Planning and Development) Regulations, 1992 (details supplied) does not apply to model aircraft but rather to full sized passenger-carrying aircraft. [22870/96]

Under the Local Government (Planning and Development) Regulations, 1994, exempted development includes the laying out and use of land for athletics and sports where there is no charge made for admission of the public to the land. Certain sports, including, among others, those involving the use of aircraft are excluded from this exemption. The term "aircraft" is not defined in the regulations and I have no power to give a ruling on the meaning which should be given to it.

Section 5 of the Local Government (Planning and Development) Act, 1963, as amended, provides that, where a question arises as to what, in any particular case, is or is not development or exempted development, the question may be referred by any of the parties concerned to An Bord Pleanála for decision. A reference of this kind may help to resolve any particular case with which the Deputy may be concerned.
