Written Answers. - Control of Skips.

84 Mr. N. Ahern asked the Minister for the Environment the situation regarding builders' skips left on public roads overnight; the regulations in this regard; if these regulations are proving successful; the plans, if any, he has to strengthen them; and if he will make a statement on the matter. [3960/97]

Section 72 of the Roads Act, 1993, gives extensive powers to road authorities to make by-laws to regulate and control skips on public roads. Such by-laws may, inter alia, specify requirements in relation to the lighting and marking of skips for the purpose of making them readily visible to road users. A decision to make such by-laws is a matter for the elected members of individual road authorities.

I intend shortly to make regulations under section 34 of the Waste Management Act, 1996, in relation to the granting by local authorities of permits to private waste collectors. Such regulations may specify conditions to be attached to a waste collection permit; the question of mandatory reflectorised markings for waste skips is being considered in this context.
