106 Mr. N. Ahern asked the Minister for Justice if the Garda Commissioner has signed the order preventing the parking of heavy trucks in Dublin residential areas on an overnight basis; the reason for the delay of over a few years in view of the fact that every request has been acceded to by Dublin Corporation and other local authorities. Section 35 of the Road Traffic Act 1994 provides for the making of regulations by the Minister for the Environment which will replace existing provisions under the Road Traffic Acts whereby the Minister for the Environment may make general traffic regulations and the Garda Commissioner may make local traffic or parking by-laws by way of temporary rules with the consent of the Minister for the Environment and the local authorities concerned.

The Commissioner and the Minister for the Environment have had under consideration the making of such temporary rules to prevent the parking of heavy vehicles in residential areas in the Dublin area. However, I understand that the drafting of the regulations referred to above is at an advanced stage. The regulations will include a specific provision to enable local authorities to restrict the parking of large vehicles in specified places or areas.

Therefore, the question of the making of temporary rules by the Commissioner does not now arise.
