Written Answers. - Auctioneers' Fees.

163 Mr. J. Walsh asked the Minister for Justice the plans, if any, she has to amend the 1973 Auctioneers and House Estate Agents Act whereby landowners would be obliged to pay auctioneers' fees rather than the current position where the lessee has to pay the fees. [6258/97]

The primary legislation governing auctioneers and house agents is set out in the Auctioneers and House Agents Acts, 1947 to 1973, and places the onus of paying auctioneer or house agent fees on the vendor, lessor or landlord. An exception to the foregoing is conacre or agistment arrangements which do not constitute lettings and, accordingly, the onus for paying the fees is on the lessee.

I assume that the Deputy's concern is about who should pay the fees for such conacre lettings and I am currently considering representations made to me on this matter.
