Written Answers - Registration of Title.

Liam Aylward

Ceist:

204 Mr. Aylward asked the Minister for Justice if she will expedite an application for transfer of property to a person (details supplied) in County Kilkenny which was lodged with the Land Registry in October 1996. [7367/97]

I am informed by the Registrar of Titles that this case refers to an application under section 49, that is acquisition of title by virtue of long possession, of the Registration of Title Act, 1964, which was lodged on 7 October, 1996, and that notice has been served on all parties whose interests are affected by the application in so far as this is possible.

I understand that, due to their complicated nature, applications under section 49 take some time to process and it is not possible to estimate a completion time at this stage.

205 Mr. Penrose asked the Minister for Justice if she will expedite the first registration application of a person (details supplied) in County Westmeath; and if she will make a statement on the matter. [7385/97]

I am informed by the Registrar of Titles that this dealing is currently being processed and that requisitions on the title have been raised. It is expected that notices will also issue to interested parties in the near future. This matter cannot proceed until the requisitions have been satisfactorily discharged and any correspondence in response to the notices to interested parties has been dealt with. It is not therefore possible to estimate a completion time at this stage.

Michael Ring

206 Mr. Ring asked the Minister for Justice if she will expedite the registration of lands with the Land Registry Office for a person (details supplied) in County Roscomon in view of the fact that the matter has been ongoing for the past six years and is causing financial hardship. [7397/97]

I am informed by the Registrar of Titles that the registration referred to by the Deputy involves a Land Commission schedule. In the case of such schedules, the property is deemed to be registered as of date of vesting by the Land Commission.

I understand that replies to queries which had issued from the Land Registry were received from the applicant's solicitor on 11 March 1997. Arising from these replies further queries will issue from the Land Registry to the applicant's solicitor in the next few days.
