259 Mr. Ring asked the Minister for Social Welfare when an appeal decision will be made for a person (details supplied) in County Mayo in view of the fact that she was told at an oral hearing on 13 March 1997 that it would take two weeks and she has heard nothing since. [9505/97]

The person concerned was in receipt of unemployment assistance at the maximum rate from February 1991. It came to attention during 1996 that she is employed by the local health board as a home help since April 1991. Following investigation her claim was disallowed from 30 October 1996 on the grounds that she is not unemployed and not available for work.

An appeal against that decision was made to the independent social welfare appeals office on 6 November 1996. An oral hearing of the appeal took place in Ballina on 13 March 1997. The appeal was disallowed on the grounds that she was not unemployed. Notification of the appeals officer's decision was issued to the person concerned on 8 April 1997. In view of the circumstances of the employment my Department will be in touch with the person concerned to see whether there is scope for a change in her current working arrangements which would enable her claim for unemployment assistance to be reassessed.
