Ceist:

60 Mr. E. Byrne asked the Minister for the Environment the number of developers' bonds which have been called in by local authorities in each of the years from 1986 to 1996 on foot of the failure by the developer to complete the works specified in the planning permission; the proposals, if any, he has to improve the system of controls; and if he will make a statement on the matter. The information requested is not available in my Department. Responsibility for the enforcement of planning control is a matter for the individual planning authorities. The Planning Acts specifically allow for conditions about the giving of security, the phasing and completion of works and the occupation of structures. Where a development does not comply with conditions, it is a matter for the relevant planning authority to take enforcement action, including calling in bonds for satisfactory completion of the development.

It is open to the planning authority or any other person to seek an Order in the High Court or Circuit Court under section 27 of the Local Government (Planning and Development) Act, 1976, as amended, requiring compliance with conditions laid down by the planning authority.

I have no immediate proposals for legislation on the enforcement of planning controls. However, the matter is among the subjects being considered for the preparation of planning guidelines by my Department.
