Go ndéanfar an ráiteas atá leagtha amach sa Sceideal a ghabhann leis an Rún seo a fhorordú mar eolas do vótálaithe de bhun alt 23 dAcht an Reifrinn, 1994 (Uimh. 12 de 1994), i ndáil leis an togra chun Airteagal 28 den Bhunreacht a leasú, atá ar áireamh sa Bhille um an Seachtú Leasú Déag ar an mBunreacht (Uimh. 2), 1997.

AN SCEIDEAL

1. Is é atá beartaithe leis an mBille um an Seachtú Leasú Déag ar an mBunreacht (Uimh. 2), 1997, an fo-alt seo a leanas a chur isteach i ndiaidh fho-alt 2 dalt 4 dAirteagal 28 den Bhunreacht:

3. Déanfar rúndacht na bpléití ag cruinnithe den Rialtas a urramú i ngach toisc ach amháin i gcás ina gcinnfidh an Ard-Chúirt gur ceart nochtadh a dhéanamh i dtaobh ní áirithe

i. ar mhaithe le riaradh cirt ag Cúirt, nó

ii. de bhua leasa phoiblí sháraithigh, de bhun iarratais chuige sin ó bhinse arna cheapadh ag an Rialtas nó ag Aire den Rialtas le húdarás Thithe an Oireachtais chun fiosrú a dhéanamh faoi ní a luafaidh siad ina thaobh go bhfuil tábhacht phoiblí ann.

2. MÁ THOILÍONN TÚ leis an togra, cuir X os coinne an fhocail TÁ ar an bpáipéar ballóide.

3. MURA dTOILÍONN TÚ leis an togra, cuir X os coinne an fhocail NÍL ar an bpáipéar ballóide.

4. Is féidir cóip den Bhille a iniúchadh nó a fháil saor in aisce in aon Phost-Oifig.

I move:

That the statement set out in the Schedule to this Resolution be prescribed for the information of voters pursuant to section 23 of the Referendum Act, 1994 (No. 12 of 1994), in relation to the proposal to amend Article 28 of the Constitution which is contained in the Seventeenth Amendment of the Constitution (No. 2) Bill, 1997.

SCHEDULE

1. The Seventeenth Amendment of the Constitution (No. 2) Bill, 1997, proposes to insert the following subsection after subsection 2 of section 4 of Article 28 of the Constitution:

3. The confidentiality of discussions at meetings of the Government shall be respected in all circumstances save only where the High Court determines that disclosure should be made in respect of a particular matter

i. in the interests of the administration of justice by a Court, or

ii. by virtue of an overriding public interest, pursuant to an application in that behalf by a tribunal appointed by the Government or a Minister of the Government on the authority of the Houses of the Oireachtas to inquire into a matter stated by them to be of public importance.

2. IF YOU APPROVE of the proposal, mark X opposite the word YES on the ballot paper.

3. IF YOU DO NOT APPROVE of the proposal, mark X opposite the word NO on the ballot paper.

4. A copy of the Bill can be inspected or obtained free of charge at any Post Office.
