The Chief State Solicitor, acting on the instructions of my Department, informed the receiver appointed to the company, in writing, that he had no entitlement to deal with the property in question; that I, as Minister, was determined to recover possession of the property; that this position should be brought to the attention of any prospective purchaser and that the receiver should give an undertaking not to purport to sell the property. A copy of this correspondence was sent to the property agents acting in the purported sale.
Solicitors for the receiver have informed the Chief State Solicitor that while they dispute aspects of the legal views expressed by him, the receiver cannot effect a sale until these issues are resolved and that he never attempted to do otherwise.
