194 Mr. U. Burke asked the Minister for Agriculture and Food when a ewe quota will be restored to a person (details supplied) in County Galway; and if he will make a statement on the matter. [22587/98]

Under EU regulations, farmers holding ewe quotas are required to use at least 70 per cent of that quota every year, otherwise the part not used will be forfeited and returned to the national reserve.

The person named held a ewe quota of 33 premium rights but did not use any of it in 1997. My Department wrote to him on 7 August 1998 seeking the reasons for its non use but no reply was received from him. The quota was, therefore, returned to the national reserve. If, however, the person named can demonstrate that he was unable to use his quota because of exceptional circumstances, the matter will be re-examined in the light of any evidence he may submit.
