110 Mr. Gormley asked the Minister for the Marine and Natural Resources his views on the removal of sand from beaches by private interests; and the proposals, if any, he has to police and prevent this activity in view of the fact that no apparent effort has been made by any authority to implement a notice displayed on Grange Beach, Fethard-on-Sea, County Wexford, which indicated that this activity is prohibited. 111 Mr. Gormley asked the Minister for the Marine and Natural Resources if his attention has been drawn to the removal of sand, on a regular basis, from the Grange Beach near Fethard-on-Sea, County Wexford; and if he will make a statement on the matter. [22613/98]

I propose to take Questions Nos. 110 and 111 together.

The Foreshore Acts, 1933 and 1992, enable me to take action in relation to the illegal disturbance or removal of beach material from specified areas of seashore or State-owned foreshore by way of the issue of prohibitory notices or the making of prohibitory orders, a breach of which would be an offence punishable by a substantial fine and/or term of imprisonment. The 1992 Act moreover specifically empowers the courts to order the mitigation or remedy of the effects of any illegal removal or disturbance in such manner and within such period as they may specify. Action is normally taken following consultation and in co-operation with the appropriate local authority, the gardaí and other interested parties.

I have made inquiries regarding the area mentioned by the Deputy and am not aware of any difficulties that have arisen at that location. I can assure the Deputy that any complaint would be investigated and arrangements made for appropriate action.
