261 Mr. McCormack asked the Minister for Agriculture and Food if other lands owned by the lessor are not relevant in any way to the REP scheme participant in the case of a REP scheme participant with leased land for longer than five years and eligible under the terms and conditions of the scheme. [28358/98]

In circumstances where the lessor is not a participant in the REP scheme, lands owned by the lessor, other than lands leased to the REP scheme participant, are not relevant to the scheme. However, the conditions of the scheme provide that the creation of farming units for the purpose of claiming or increasing payments under the scheme is prohibited. Therefore, where, prior to the submission of an application for the REP scheme, an applicant has leased land to a participant in the scheme the situation in relation to that land would have to be assessed as part of the approval process.
