399 Mr. Higgins (Dublin West) asked the Minister for the Environment and Local Government if he will make available copies of the reports to the European Commission on waste disposal in this country pursuant to article 12 of EEC Council Directive 75/442. [7685/99]

401 Mr. Higgins (Dublin West) asked the Minister for the Environment and Local Government if he will make available copies of the questionnaires completed by the Government and supplied to the European Commission under EC Council Decision 94/741 of 24 October 1994. [7687/99]

I propose to take Questions Nos. 399, 400 and 401 together.

Reports under Article 12 of Council Directive 75/442/EEC were submitted to the European Commission in 1982 and 1986 on the basis of questionnaires issued to member states by the Commission.

The reporting requirements under Directive 75/442/EEC were amended by Council Directives 91/156/EEC and 91/692/EEC so that the first report by member states to the Commission under the revised directive covers the period 1995 to 1997 inclusive.

Council Decision 94/741/EC adopted three questionnaires to be used as a basis for sector reports to the Commission in respect of the implementation of Council Directives 75/439/EEC, 75/442/EEC, as amended by Council Directive 91/156/EEC, and 86/278/EEC, during the period 1995 to 1997 inclusive. Ireland has submitted the requisite reports. A copy of the reports referred to above will be made available to the Deputy.

402 Mr. Higgins (Dublin West) asked the Minister for the Environment and Local Government if he will make available copies of his Department's inspectors' reports or any other reports prepared for Department on the environmental impact statements submitted to him but not certified or determined by him before the transfer of waste licensing functions to the Environmental Protection Agency on the introduction of the Waste Management (Licensing) Regulations, 1997. [7688/99]

The Local Government (Planning and Development)(No. 3) Regulations, 1997, provide that Part IX of the Local Government (Planning and Development) Regulations, 1994, shall not apply to the development of a facility in relation to which a waste licence is required.

At the time these regulations were made, there were two applications for ministerial certification under article 119 of the 1994 regulations in respect of proposed waste facilities. These related to proposed landfill developments at Ballynagran-Coolbeg-Kilcandra in County Wicklow and Hardbog, Grangemockler, County Tipperary. A copy of reports prepared within my Department in respect of these applications will be made available to the Deputy.
