418 Mr. Sargent asked the Minister for the Environment and Local Government when the regulations covering the transposition of batteries will be in place; and if he will make a statement on the matter. [7976/99]

The Waste Management (Hazardous Waste) Regulations, 1998, implement relevant provisions of Council Directive 91/157/EEC on batteries and accumulators containing certain dangerous substances. These regulations came into operation on 20 May 1998 and replace and update a number of regulations made under the European Communities Act, 1972, which were revoked with effect from that date, including the European Communities (Batteries and Accumulators) Regulations, 1994.

The European Communities (Dangerous Substances and Preparations) (Marketing and Use) Regulations, 1994, which were made by the then Minister for Enterprise and Employment, give effect to article 3.1 of Directive 91/157/EEC.

This directive has been amended by Commission Directive 98/101/EC, of 22 December 1998. Member states are required before 1 January 2000 to adopt the legislative provisions necessary to comply with the amended directive.
