114 Mr. Aylward asked the Minister for Agriculture and Food further to Parliamentary Question No. 172 of 5 May 1999 the reason a person (details supplied) in County Kilkenny has been penalised at 100 per cent; the reason an individual should be penalised in a commonage area; and if he will make a statement on the matter. [12375/99]

Some considerable time ago the person named was requested to furnish proof of his entitlement to claim an entire commonage. Thus far no reply has been received. In the absence of a response from the person named the appropriate penalty was imposed. In accordance with the relevant EU regulation as the difference between the area claimed and found is more than 20 per cent of the area found it results in no area linked aid being paid to the person named for 1998.
