104 Mr. Perry asked the Minister for Agriculture and Food if a decision has been made on an appeal by a person (details supplied); and if he will make a statement on the matter. [14281/99]

This appeal is currently being examined and it is expected that it will be concluded within two weeks. The herdowner will be notified of the outcome.

105 Mr. Perry asked the Minister for Agriculture and Food if a person (details supplied) in County Sligo will have the penalty imposed on his suckler cow payment waived or reduced in view of the fact that an error was made as he was given the incorrect cards at the local mart; and if he will make a statement on the matter. [14282/99]

The person named applied for 18 suckler cows under the 1998 cattle headage scheme and the 1998 suckler cow premium scheme on 25 May 1998.

At an inspection carried out on 23 November 1998 only 17 of the cows listed on the claim were presented for inspection. Further checks revealed that one animal on the claim was not in the ownership and possession of the person named on the date of application.

Given the circumstances of the case it was concluded that the animal in question should not receive payment and the other animals in the claim should receive a reduced payment. This is the minimum penalty applicable in such cases.

The person in question was informed of the decision on 2 December 1998. It is open to the applicant to appeal the decision if he considers there are aspects of the case that require further examination.
