I propose to take Questions Nos. 44, 76, 91, 100, 115, 116 and 117 together.
By 25 June 1999 the total cost of awards, settlements and plaintiffs' legal costs paid by my Department in Army hearing loss claims was £83 million. A sum of £2.8 million has been paid in respect of 176 court awards, while out of court settlements in 3,215 cases have cost £61.3 million. Plaintiffs' legal costs amount to £18.9 million paid to date. A total of 10,768 claims remain outstanding.
Given the current and potential scale of the problem, allied to the complex legal and medical variables, it is difficult to be precise about the future cost. In addition, cost projections are based on the scale of damages laid down by the High Court in the case of Hanley v. Minister for Defence. Following that judgment, my Department estimated that the total cost of claims outstanding at that time would be of the order of £550 million, excluding legal costs. The Supreme Court appeal in the Hanley case will be heard in the Supreme Court tomorrow, 1 July 1999 and the main issue of the appeal is the scale of damages.
