The applicant has appealed the imposition of penalties following a compliance inspection. The appeal is currently being reviewed by the Department's inspectorate and a decision will be made shortly.
295 Mr. Ring asked the Minister for Agriculture and Food the reason a person (details supplied) in County Galway has not received payment of the 1998 headage and premia when the area aid unit of his Department was processing this for payment on 15 June 1998. [17619/99]
Difficulties arose with the area aid application by the person named in that insufficient information was available to enable the complete digitising of his land. The area aid unit of my Department contacted the person named in this matter. The documentation received as a result of these communications is now being processed and any payments due will issue as soon as possible.

A problem with the 1998 area aid application of the person named has now been resolved and extensification premium will issue shortly.
297 Mr. Flanagan asked the Minister for Agriculture and Food the reason payments under the rural environment protection scheme have not been made to farmers in the upper Ballyfin and Ballyfin mountain area of County Laois all of whom have established long-term grazing rights on the mountain; and if he will make a statement on the matter. Some participants in REPS claimed payment on land part of which included Ballyfin Mountain which was identified on their agri-environmental plans either as commonage or as registered grazing rights. My Department was unable to find any evidence that this land was registered and it was therefore ineligible for payment. The onus lies with the applicant to establish eligibility under the scheme. If the land to which the grazing rights attach are unregistered they would be ineligible for payment.
298 Mr. Ring asked the Minister for Agriculture and Food the reason persons (details supplied) in County Mayo were refused entry into the REP scheme; and the reason it took over two years for a decision to be made. [17384/99]
The persons named submitted a joint application to join REPS in December 1997. The documentation submitted was incomplete.
299 Mr. Ring asked the Minister for Agriculture and Food when a person (details supplied) in County Mayo will receive approval for an installation grant; and the reason for the delay in this regard. [17385/99]
As the documentation submitted with the application for installation aid in this case was incomplete, my Department contacted the applicant on two occasions seeking further supporting documentation. The most recent request was made on 30 June 1999. Further information, recently received in support of the application, is currently being examined by my Department and if sufficient to meet the terms and conditions of the scheme, payment will issue in the near future.
