Liam Aylward

335 Mr. Aylward asked the Minister for Agriculture and Food the progress to date on the appeal by a person (details supplied) in County Kilkenny against the decision of his Department to disqualify him for one year under the special beef premium ten and 22 months scheme. [18146/99]

The appeal in respect of the above named person is being processed. It is expected that the district inspector will finalise his report shortly and a decision will then issue to the appellant.

336 Mr. Ellis asked the Minister for Agriculture and Food if his Department will pay 1998 premium and extensification to a person (details supplied) in County Leitrim; and the reason for the delay. [18147/99]

The person named applied for and was paid on the basis of eight suckler cows under the 1998 suckler cow premium scheme. He applied for, and was paid on the basis of five animals under the 22 month age category of the 1998 special beef premium scheme. He also applied for three animals under the ten month 1998 special beef premium scheme but the date of birth of one of the animals applied on differed from that registered with the central register in Bandon. A letter issued to the herdowner on 30 June 1999 regarding this discrepancy but no reply has been received to date. On receipt of a satisfactory reply any outstanding payments due to the herdowner under the special beef or extensification premium schemes will be issued.

337 Mr. Aylward asked the Minister for Agriculture and Food if he will make financial aid available under the hardship fund to a person (details supplied) in County Kilkenny whose herd has been locked up since February 1999. [18148/99]

Under the TB and brucellosis eradication schemes, the eligibility period for the 1998/1999 hardship scheme was between 1 November 1998 and 30 April 1999, inclusive. While the holding of the person in question was restricted under the TB eradication scheme during this eligibility period, the required qualifying full herd re-test did not take place until after the expiry of the eligibility period. A a result, the person in question is not entitled to a hardship grant payment under the 1998/1999 hardship scheme. However, if the holding of the person in question continues to be restricted on or after 1 November 1999 and provided, first, he makes an application under the 1999/2000 hardship scheme, and second, he meets all the eligibility criteria for the 1999/2000 hardship scheme, he may qualify for a grant payment under the arrangements for that hardship scheme.

338 Mr. Ellis asked the Minister for Agriculture and Food if his Department will make a REP scheme payment to a person (details supplied) in County Sligo. [18149/99]

This application was chosen at random for a pre-payment inspection. Following this inspection penalties were imposed. The applicant has appealed these penalties. Subsequently an appeals inspection was carried out on 20 September 1999 and a report will be sent to the REPS appeals committee this week. The applicant will be notified of the decision in due course.

339 Mr. Ellis asked the Minister for Agriculture and Food if his Department will pay equine headage to a person (details supplied) in County Sligo; and the reason for the delay in payment. [18151/99]

The above named did not submit an area aid application form in 1998. Subsequently, in conjunction with a medical certificate dated 29 March 1999, a 1998 application form was received. However, the medical certificate submitted did not cover the application period for 1998 forms. The area aid unit did not therefore accept the medical certificate.

340 Mr. Ellis asked the Minister for Agriculture and Food if his Department will pay a 1997 and 1998 REP scheme grant to a person (details supplied) in County Leitrim which was passed for payment at the local office. [18152/99]

Payments in respect of REP scheme for 1997 and 1998 will issue to the person concerned shortly.

342 Mr. Ellis asked the Minister for Agriculture and Food if his Department will pay headage and premium and extensification grants to a person (details supplied) in County Sligo. [18156/99]

No area aid application form was received from the person named in 1998. However, on the basis of the medical certificate submitted, it was agreed that a late application would be accepted.

A problem arose in that the applicant did not submit a map showing the boundaries of the plots included on his application. Maps were subsequently issued to the herdowner to enable him to outline these plots. These maps have not yet been returned to the area aid unit. It is not possible therefore to process his application to completion.

No payments can issue until all area aid documents are in order.

343 Mr. Ellis asked the Minister for Agriculture and Food if his Department will pay reactor grants to a person (details supplied) in County Sligo. [18157/99]

Appropriate TB reactor grants were paid to the herdowner in question on 24 September 1999. Appropriate income supplement payments are currently being processed and will issue to him in due course.

344 Mr. Ellis asked the Minister for Agriculture and Food if his Department will pay arrears of REP scheme to a person (details supplied) in County Leitrim. [18158/99]

This application was chosen at random for a detailed plan examination and on-farm inspection. Following the inspection, the agri-environmental plan was found to contain a num ber of deficiencies which needed to be rectified. The applicant's REPS planner has been requested to submit a revised agri-environmental plan. Payment cannot be processed until a satisfactory plan is received.

A 1998 area aid application for the person named was received after the closing date and postal certificate was requested from the applicant. The postal certificate was received in the area aid unit and the application has been finalised. Payments in respect of suckler cow and special beef premia and extensification have been made to the person named and any outstanding payments will issue as soon as possible.

347 Mr. Yates asked the Minister for Agriculture and Food if a 1998 extensification premium payment will be paid to a person (details supplied) in County Wexford in view of the fact that there was an error on the ages of the animals which affected the livestock units. [18161/99]

Stocking Density

63.3/44.00 = 1.43Lu/Ha.

Regrettably there is no discretion in relation to establishing the LU value of the animals applied on. It must be by reference to date of birth and if over 24 months the animals in question must be treated as ILU.
The person named has a stocking density of 1.43 Lus/Ha and therefore has no entitlement to 1998 extensification premium.
