826 Mr. Perry asked the Minister for Education and Science if his attention has been drawn to the difficulties a person (details supplied) in County Sligo has encountered in re-sitting his examination; and if he will make a statement on the matter. [17547/99]

Under the Regional Technical Colleges Act, 1992, the management and control of the affairs of an institute of technology is a function of the director and the governing body. In accordance with the Act, the regulations for the conduct of examinations are made by the institute's governing body subject to the requirements of the National Council for Educational Awards – or other conferring body. Accordingly, I have no function in regard to the examinations conducted in the institute and I am not in a position to intervene in the processing, of the examination applications.

However, I have had inquiries made with the Institute of Technology, Sligo and they have advised me that, having reviewed the circumstances surrounding the candidate, the institute was unable to process his application which was received after the closing date for receipt of late applications.
