188 Mr. J. O'Keeffe asked the Minister for Finance if he has completed his review of the capital acquisitions tax code; his views on the fairness of the system in particular in relation to the family home and for those whose common law partners have died; and the proposals, if any, he has in this regard. As the Deputy is aware, I am reviewing the capital acquisitions tax code in detail for the forthcoming budget. It would be inappropriate to comment on any changes which may be made to the legislation in this regard, prior to budget day.

I undertook to examine the capital acquisitions tax code earlier this year in the course of the Finance Bill debate. I appreciate the concerns which have been raised in relation to this tax, particularly on the inheritance of the family home. I am aware of the tax burden this could place on certain individuals, including co-habiting couples. This and other issues will be borne in mind in the context of the current review.
