Written Answers. - Housing Estates Completion.

246 Mr. Browne (Carlow-Kilkenny) asked the Minister for the Environment and Local Government the plans, if any, he has to hold builders legally responsible for the completion of housing estates as shown on advertising brochures in order to prevent serious changes once the development is under way. I refer to my answer to Question No. 163 on Wednesday 10 November 1999 in relation to the issue of unfinished estates which may be of assistance to the Deputy.

The construction of new developments including housing estates must be carried out in accordance with a grant of planning permission including any conditions which may be imposed as part of a grant of permission. Failure to comply with a grant of permission is an offence. I have no function regarding how developments are advertised.

The Planning and Development Bill 1999 which is currently before the Seanad includes updated and strengthened provisions regarding the enforcement of planning law. The Bill when enacted will also enable a planning authority to refuse to grant permission to a developer based on past performance, subject to the consent of the High Court. These measures will be effective in ensuring that planning law is respected and enforced where necessary.
