336 Mr. Gregory asked the Minister for Justice, Equality and Law Reform the position regarding the application of a person (details supplied) in Dublin 1 for citizenship and a job permit. [24452/99]

The person referred to by the Deputy applied for asylum in Ireland. His application was unsuccessful at initial stage. He appealed the decision but prior to his appeal being heard he withdrew his claim for asylum and applied for permission to remain on the basis of his marriage to an EU national. Certain criteria must be met for a person to obtain residency on this basis, one of which is that the EU national is in fact residing in the State. This application is currently under examination, in accordance with the provisions of the relevant EU Rights of Residence Directives, and it is expected that a decision will be reached in the near future.

My Department is not aware that an application for citizenship or for a work permit has been made in respect of the person referred to.
