Liam Aylward

112 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development the outcome of an appeal by a person (details supplied) in County Kilkenny regarding his 1998 area aid application. [27272/99]

The herdowner was informed on 13 September 1999 that the appeal which he lodged concerning his 1998 area aid application was unsuccessful. I understand this case is currently being examined by the Office of the Ombudsman.

113 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when a special beef premium will be paid to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [27273/99]

In processing the area aid application for the person named it emerged that a land parcel being claimed by the applicant was also being claimed by another person. In order to resolve this matter, my Department wrote to the parties concerned to submit evidence of their entitlement to claim on this parcel of land. This case cannot be cleared for payment until this matter is finalised.

114 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive the balance payment of a 1999 suckler cow premium and her full payment entitlement under the 1999 cattle headage scheme; and when she will receive the balance payment of a 1998 suckler cow premium. [27274/99]

A payment of £739.60 issued to the person named in late November representing a partial advance payment under the 1999 suckler cow premium scheme.

A further payment of £1254.65 will issue to the person named within the next week. This payment represents £59.24 under the 1999 suckler cow premium scheme, which, taken together with the £793.60 already paid, represents her full entitlement under the 1999 suckler cow premium advance; £1062.60 representing full entitlement under the 1999 cattle headage scheme; and £132.81, representing a balance due under the 1998 suckler cow premium scheme.

Balancing payments under the 1999 suckler cow premium scheme will be payable early in the new year.

115 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle and sheep headage. [27275/99]

The 1999 area aid application for the person named has now been fully processed, and any payments due will issue as soon as possible.

116 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 sheep and cattle headage. [27276/99]

The person named applied for a total of 27.28 hectares on his 1999 area aid application form. Following processing of his application an area of 26.80 hectares was determined. This represents a difference of .48 hectares or 1.79 % between the area claimed and that determined.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied.

Therefore in this case no penalty is applied, leaving the area determined for payment at 26.80 hectares. Any payments due will issue as soon as possible.

117 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle headage in view of the fact that he has submitted proof of entitlement to his commonage. [27277/99]

An over-claim has been identified on one of the land parcels claimed by the person named in 1999. Maps have issued to him and he has also been informed of the extent of this overclaim.

Additionally one of the parcels claimed by the person named in his 1999 area aid application overlaps with a parcel of land claimed by another applicant. Both herd owners have been written to, with a view to resolving the problem and a response is awaited. No payments can issue until these matters have been satisfactorily resolved.

118 Mr. Enright asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Laois has not receive 1999 area aid payment for all lands outlined in his application. [27289/99]

The person named submitted an area aid application which included a parcel in respect of which a dual claim was determined. My Department has contacted both herdowners to clarify the matter. No payments can issue until this matter has been satisfactorily resolved.
