Ceist:

327 Mr. M. Ahern asked the Minister for Agriculture, Food and Rural Development if the decision not to make a payment of 1999 area aid to a person (details supplied) in County Cork will be reconsidered. [2001/00]

The closing date for the receipt of area aid applications was 23 April 1999. Late applications incurring daily penalties were accepted up to 18 May 1999. As the application form for the person named was not received until 9 June 1999 a 100% penalty must be applied in accordance with the EU regulations.

Ceist:

328 Mr. McGinley asked the Minister for Agriculture, Food and Rural Development when 1999 sheep headage will be paid to a person (details supplied) in County Donegal. [2026/00]

During the processing of the 1999 area aid application of the person named it was determined that one of the parcels of land which he is claiming is also being claimed by other herdowners as commonage. A letter and maps issued to him with a view to clarifying the position.

He has since responded indicating that he has an application currently with the Land Registry to change the land in question from its current status of commonage, to wholly owned land registered in the herdowner's name. No payments can issue until he has furnished proof of his entitlement to claim on this land.
