Carey asked the Minister for Agriculture, Food and Rural Development if he will acknowledge that the penalty for under or over declaration of lands farmed under the REP scheme is not being applied in all regions due to a difference of opinion among senior staff of his Department; and if he will refer the penalty regime to his Department's legal adviser for an opinion on the matter.
